Terms of Use (EULA)

Introduction

Welcome to Pith. By downloading, installing, or using the Pith app ("the App"), you agree to these Terms of Use (EULA) ("Terms"). If you do not agree to these Terms, do not use the App.

Pith is a privacy-first voice recording and AI summarization app for iPhone. Everything happens on your device. No accounts. No servers. No cloud. These Terms explain your rights and responsibilities when using the App.

1. Acceptance of Terms

By using Pith, you confirm that:

• You are at least 13 years old (or the minimum age required in your jurisdiction)
• You have the legal capacity to enter into a binding agreement
• You agree to comply with all applicable laws and regulations

2. Description of Service

Pith provides on-device voice recording and AI-powered summarization natively processed on your local hardware. The App operates entirely on your iPhone and does not transmit your voice recordings, transcripts, or summaries to any external servers.

Key features:

• Three recording modes: Journal, Briefing, and Conversation
• On-device processing (no internet required)
• AI-generated summaries with action item extraction
• Follow-up Q&A with recorded sessions
• Weekly reflection letters
• One-tap sharing of summaries

What we don't do:

• We do not create user accounts or require sign-in
• We do not store your recordings or transcripts (they are deleted after processing)
• We do not upload your data to external servers
• We do not collect analytics or usage data

3. Subscription and Pricing

Pith offers a free tier and paid subscription plans managed entirely through Apple's App Store:

We do not have access to your payment information. All transactions are processed by Apple.

4. User Responsibilities

4.1 Recording Consent

You must obtain all necessary consent before recording any conversation. Recording laws vary by jurisdiction:

• Some locations require all parties to consent to being recorded (two-party consent)
• Other locations require only one party (you) to consent (one-party consent)
• Some locations prohibit recording entirely in certain contexts

You are solely responsible for knowing and complying with the recording laws in your jurisdiction. Pith is a tool. How you use it is your responsibility. We are not liable for any illegal recordings made using the App.

4.2 Accuracy of AI Summaries

Pith uses AI to generate summaries. AI can make mistakes. You are responsible for verifying the accuracy of all AI-generated content. Do not rely solely on Pith's output for:

• Medical decisions or treatment plans
• Legal advice or documentation
• Financial decisions
• Any situation where inaccuracy could cause harm

Always review AI-generated summaries and cross-check important details.

4.3 Backup and Data Loss

Pith stores all data locally on your iPhone. You are responsible for backing up your device. If you lose your iPhone, reset your device, or delete the App, your Pith data will be lost. We cannot recover it.

We recommend using iCloud Backup or iTunes Backup to protect your data.

4.4 Prohibited Uses

You may not use Pith to:

• Record conversations without proper consent
• Violate any local, state, national, or international law
• Harass, threaten, or harm others
• Infringe on intellectual property rights
• Reverse engineer, decompile, or disassemble the App
• Attempt to extract or modify the App's AI models or source code
• Use the App for any unlawful or unethical purpose

5. Intellectual Property

Pith and all related trademarks, logos, and content are owned by the developer. The App is licensed to you, not sold. You may not:

• Copy, modify, or distribute the App
• Create derivative works based on the App
• Remove or alter any copyright or proprietary notices

6. Privacy and Data Collection

Pith is designed with privacy as a core principle:

• What we collect: Nothing. Pith does not collect, store, or transmit any personal data, usage analytics, or telemetry.
• What stays on your device: AI-generated summaries and user preferences (stored locally).
• What is deleted: Raw audio recordings and transcripts (deleted after processing).

7. Device Requirements

Pith requires:

• iPhone 15 Pro or later
• iOS 18.1 or later

The App will not function on devices that do not meet these requirements. We do not offer refunds for purchases made on incompatible devices if you bypassed our compatibility checks.

8. Disclaimers and Limitation of Liability

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND.

To the fullest extent permitted by law:

• We make no guarantees about the accuracy, reliability, or availability of the App
• We are not liable for any data loss, including lost recordings or summaries
• We are not liable for any damages arising from your use of the App, including but not limited to inaccurate AI summaries, lost or corrupted data, legal consequences from illegal recordings, or harm caused by reliance on AI-generated content
• Our total liability for any claim will not exceed the amount you paid for the App in the 12 months preceding the claim

You use Pith at your own risk.

9. Termination and Suspension

We reserve the right to:

• Discontinue the App at any time for any reason
• Modify or remove features without notice
• Terminate your access if you violate these Terms

If we discontinue the App:

• Active subscriptions will be canceled (refunds handled by Apple per their policies)
• You will retain access to locally stored data until you delete the App

10. Changes to These Terms

We may update these Terms from time to time. Changes will be effective when posted. Continued use of the App after changes are posted constitutes acceptance of the new Terms.

We will notify users of material changes through an in-app notification or an update to the "Last Updated" date at the top of this document.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App will be resolved in the courts of Ontario, Canada.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the developer regarding the use of Pith.
